Welcome to Treeline Motorsports Inc. (“Treeline,” “we,” “us,” or “our”). These Terms & Conditions govern your use of our website, booking services and dirt-bike rental services.

By making a booking, paying for a rental, or participating in a rental activity with Treeline Motorsports Inc., you agree to these Terms & Conditions and to the terms of the applicable Dirt Bike Rental Agreement, Assumption of Risk, Waiver, Release & Indemnity.

Please read these Terms carefully before booking. Dirt-bike riding is an inherently dangerous recreational activity that can result in serious injury, permanent disability or death.

 

1. ELIGIBILITY

To rent and operate a dirt bike from Treeline Motorsports Inc., you must:

• Meet the minimum age and rider requirements established by Treeline;
• Provide valid government-issued identification;
• Provide accurate contact and payment information;
• Have sufficient physical ability, skill and experience to safely operate the motorcycle;
• Complete any required safety orientation;
• Wear all required protective equipment; and
• Comply with all applicable laws, regulations, trail rules and land-use restrictions.

Treeline reserves the right to refuse or cancel a rental if we reasonably believe a rider is impaired, unsafe, inadequately skilled, dishonest, or otherwise unable to safely operate the motorcycle.

 

2. BOOKINGS

A booking is not confirmed until Treeline has received the required payment and confirmation has been provided.

The person making the booking is responsible for ensuring that all information provided is accurate.

Only the individual identified as the authorized rider may operate the rented motorcycle unless Treeline provides written authorization otherwise.

Bookings are subject to availability.

 

3. RENTAL PERIOD

The motorcycle must be picked up and returned at the agreed time and location.

Late returns may result in additional rental charges.

The motorcycle must be returned in substantially the same condition in which it was provided, ordinary wear and tear excepted.

Treeline may charge the renter for damage, loss, missing equipment, unauthorized use, late return or other amounts properly owing under the Rental Agreement.

 

4. CANCELLATION POLICY

Our current cancellation policy is:

Cancellation more than 24 hours before the rental: Full refund.

Cancellation less than 24 hours before the rental: 50% refund.

No-show: Full booking amount charged.

If Treeline must cancel a rental due to safety concerns, mechanical problems, wildfire restrictions, government or land closures, severe weather or other circumstances beyond our reasonable control, Treeline will provide the applicable refund or alternative arrangement in accordance with our cancellation policy and applicable law.

 

5. SECURITY / DAMAGE DEPOSIT

A security or damage deposit may be required before the motorcycle is released.

The deposit may be used toward amounts properly owing under the Rental Agreement, including eligible:

• Damage;
• Loss;
• Theft;
• Missing equipment;
• Excessive cleaning;
• Late-return charges; or
• Other agreed charges.

Any applicable deposit amount and payment requirements will be disclosed before the rental.

 

6. DAMAGE AND LOSS

The renter is responsible for the motorcycle during the rental period, subject to any applicable damage waiver or insurance protection purchased from Treeline.

The renter may be financially responsible for damage or loss resulting from, among other things:

• Collision or crash;
• Dropping the motorcycle;
• Negligent or reckless operation;
• Unauthorized riders;
• Prohibited activities;
• Racing or competition;
• Intentional damage;
• Improper use;
• Failure to properly secure the motorcycle;
• Theft resulting from failure to reasonably secure the motorcycle;
• Incorrect fuel or fluids;
• Loss of keys or equipment; or
• Breach of the Rental Agreement.

The renter must immediately notify Treeline of any accident, damage, theft or mechanical problem.

 

7. PROHIBITED USE

Treeline motorcycles may not be:

• Used for racing, competition or timed events;
• Used for motocross or organized racing;
• Used for intentional stunts or other prohibited high-risk activities;
• Operated while impaired by alcohol, cannabis, drugs or medication;
• Operated by an unauthorized rider;
• Used to carry passengers;
• Used to tow another person, vehicle or object;
• Modified or mechanically altered without authorization;
• Used in areas where motorized recreation is prohibited;
• Used contrary to applicable laws or land-use restrictions;
• Used in a manner that causes unnecessary environmental damage; or
• Subleased, loaned, sold or transferred to another person.

Treeline may immediately terminate a rental if prohibited use occurs.

 

8. RIDING AREAS AND LAND ACCESS

Riders are responsible for operating motorcycles only in areas where motorized recreational use is legally permitted.

Information provided by Treeline regarding trails, roads, riding areas or routes is provided for general informational purposes and does not guarantee that an area is open, legal, safe or suitable for riding at the time of your rental.

Trail conditions, closures, wildfire restrictions, weather, wildlife, forestry operations and land-use rules can change without notice.

Riders must comply with all applicable signs, closures, regulations and access restrictions.

 

9. SAFETY EQUIPMENT

Riders must wear appropriate protective equipment while operating a Treeline motorcycle, including:

• An approved motorcycle helmet;
• Eye protection;
• Gloves;
• Appropriate footwear;
• Long pants; and
• Appropriate protective riding apparel.

Treeline strongly recommends additional protection including body armour, knee protection and elbow protection.

Protective equipment reduces risk but cannot eliminate the possibility of serious injury or death.

 

10. SAFETY ORIENTATION

All riders may be required to complete a safety briefing and motorcycle orientation before receiving a motorcycle.

Riders must follow all instructions provided by Treeline.

If a rider believes that the motorcycle, trail, weather or riding conditions are unsafe, the rider must immediately stop riding and contact Treeline.

 

11. ASSUMPTION OF RISK

Dirt-bike riding is an inherently dangerous activity.

Risks include, but are not limited to:

• Falls and loss of control;
• Collisions;
• Mechanical failure;
• Uneven or unstable terrain;
• Rocks, gravel, mud, sand, snow and water;
• Steep slopes and drop-offs;
• Trees, branches, roots and other obstacles;
• Roads and vehicles;
• Other riders and trail users;
• Wildlife;
• Weather and wildfire;
• Remote locations;
• Delayed emergency response;
• Fatigue and dehydration;
• Rider error or inexperience; and
• The negligence or actions of other persons.

These risks can result in property damage, serious bodily injury, permanent disability or death.

By booking and participating in a Treeline rental, you acknowledge these inherent risks and agree to assume them to the fullest extent permitted by law.

 

12. WAIVER AND RELEASE

IMPORTANT — THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

As a condition of participating in a Treeline dirt-bike rental, each rider must complete and sign Treeline’s Dirt Bike Rental Agreement, Assumption of Risk, Waiver, Release & Indemnity before operating a motorcycle.

The signed agreement contains a detailed assumption of risk and release of claims, including claims arising from negligence or breach of duty by Treeline and its personnel, to the fullest extent permitted by Alberta law.

The signed Rental Agreement forms part of the contract between Treeline and the renter.

Nothing in these Terms is intended to exclude, restrict or waive any right or protection that cannot legally be excluded, restricted or waived under applicable Alberta law.

 

13. ACCIDENTS AND EMERGENCIES

In an emergency, riders should first contact emergency services by calling 911.

All accidents, injuries, thefts, significant damage and mechanical failures must be reported to Treeline as soon as reasonably possible.

Riders must cooperate with emergency personnel, law enforcement, Treeline and applicable insurers following an incident.

 

14. WEATHER, WILDFIRE AND TRAIL CONDITIONS

Treeline may postpone, cancel or terminate a rental when conditions create an unreasonable safety concern.

These circumstances may include:

• Severe weather;
• Wildfire;
• Fire restrictions;
• Trail closures;
• Government restrictions;
• Unsafe trail conditions;
• Mechanical concerns; or
• Other circumstances affecting rider safety.

Riders are also responsible for using reasonable judgment throughout the rental and must stop riding when conditions become unsafe.

 

15. MECHANICAL PROBLEMS

Riders must immediately stop operating a motorcycle if they become aware of a mechanical problem or believe the motorcycle is unsafe.

Riders must contact Treeline before attempting repairs.

Riders must not disassemble, modify or repair a motorcycle without authorization.

 

16. PERSONAL PROPERTY

Treeline is not responsible for loss, theft or damage to personal belongings brought by riders, except where otherwise required by law.

Riders are responsible for securing their own personal property.

 

17. WEBSITE USE

All content on this website, including photographs, graphics, text, logos, descriptions and other materials, is owned by or licensed to Treeline Motorsports Inc. unless otherwise indicated.

You may not reproduce, modify, distribute or commercially use our website content without written permission.

Treeline makes reasonable efforts to keep website information accurate and current but does not guarantee that all website content, availability, pricing or descriptions are error-free or continuously available.

 

18. PRICING

Prices displayed on the website are subject to change without notice.

The price applicable to a confirmed booking will be the price presented at the time the booking is completed, subject to applicable taxes, fees and disclosed charges.

 

19. PRIVACY

Treeline collects and uses personal information necessary to process bookings, communicate with renters, operate the business, administer rentals and meet legal or insurance requirements.

Personal information will be handled in accordance with applicable privacy legislation and Treeline’s Privacy Policy.

 

20. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Treeline Motorsports Inc. is not responsible for losses arising from circumstances outside our reasonable control, including weather, wildfire, trail closures, government restrictions, natural hazards, mechanical or operational disruptions, or actions of third parties.

Nothing in these Terms limits liability or excludes rights where doing so would be prohibited by applicable Alberta or Canadian law.

 

21. GOVERNING LAW

These Terms and any rental agreement between you and Treeline Motorsports Inc. are governed by the laws of the Province of Alberta and the applicable laws of Canada.

Subject to applicable law, disputes shall be determined by the courts of Alberta.

 

22. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in effect.

 

23. CHANGES TO THESE TERMS

Treeline may update these Terms & Conditions from time to time.

The version applicable to a rental will be the version in effect when the booking is made, unless otherwise required by law or expressly agreed between the parties.

ACKNOWLEDGEMENT

By proceeding with a booking, you acknowledge that:

☐ You understand that dirt-bike riding involves inherent risks, including serious injury and death.

☐ You understand that you will be required to sign the Company’s full Rental Agreement, Assumption of Risk, Waiver, Release & Indemnity before operating a motorcycle.

☐ You agree to comply with all applicable safety requirements, laws, trail rules and land-use restrictions.

☐ You confirm that the information you provide to Treeline is accurate.

Treeline Motorsports Inc. reserves the right to refuse or terminate a rental where reasonably necessary for safety, legal, insurance or operational reasons, subject to applicable law.
